Boyer dedicates his practice to resolving complex business and commercial disputes, including intellectual property matters, real estate and product liability cases. Boyer has successfully handled all aspects of commercial and business litigation, in trials, arbitrations and appeals.

Outside the courtroom, Boyer is active in the legal community and is a member of the Association of Business Trial Lawyers of San Diego; the San Diego Intellectual Property Law Association; Federal Bar Association, San Diego Chapter; and previously served on the board of directors for the San Diego County Bar Foundation and San Diego Barristers Club.

Boyer earned his bachelor’s degree from Yale University, magna cum laude with great distinction, and graduated from the University of California, Berkeley, Boalt Hall School of Law in 1994, where he was a member of the moot court board. He also externed for Justice Ronald M. George of the California Supreme Court.

In his free time, Boyer enjoys golf, fishing and spending time with his wife and two daughters.

Litigation Practice Areas & Notable Cases
Real Estate Litigation: Trial

Represented the San Diego Marriot Hotel and Marina in the trial of a lease dispute with one of the hotel’s commercial tenants. Boyer obtained a favorable jury verdict for his client, which he successfully defended on appeal

Commercial Litigation: Judgment

Obtained a $3.17 million judgment for client, a contract manufacturer, in a commercial case involving the design and manufacturer of industrial lighting equipment. Boyer also recovered approximately $800,000 of inventory for his client

Intellectual Property Litigation: Settlement

Successfully defended a skin care company, Skinceuticals, Inc., in federal litigation involving Lanham Act claims

Professional Responsibility: Defense

Successfully defended several attorneys at a national law firm in a major federal court sanctions proceeding with partner David Noonan. After evidentiary hearings in federal court, no sanctions were imposed against the clients

Real Estate Litigation: Trial

Represented a martial arts business in a lease dispute against its landlord, a multinational corporation. Boyer obtained a jury verdict in his client’s favor as well as more than $100,000 in attorney’s fees

Commercial Litigation: Trial

Successfully defended a claim to renew a judgment plus interest of $1 million against his client, securing the dismissal of the case, which was affirmed on appeal in a published opinion – Cadle Co. II, Inc. v. Sundance Financial, Inc., 154 Cal.App.4th 622 (2007)

Commercial Real Estate Broker v. Commercial Tenant: Settlement

Represented a commercial real estate broker, with his partner James Lance, regarding the failure of its client to pay a commission. The case settled for $1 million prior to trial

Real Estate Litigation: Trial

Represented Plaintiff Escondido Medical Arts LP, owner of a medical office building, in the trial of an unlawful detainer action against a tenant. The tenant retained counsel and opposed the lawsuit, claiming he had been defrauded and had overpaid his rent, entitling him to stay rent free for several months with a substantial future rent reduction. After trial in San Diego Superior Court, the court found in favor of Escondido Medical Arts Associates LP, evicting the tenant and awarding Boyer’s client more than $60,000
